How do I file a complaint about a sleep center?

To file a complaint about a sleep center, first check whether the facility holds current AASM accreditation, then submit the appropriate complaint form to the AASM and/or the US Department of Health and Human Services (HHS). Follow the steps below in order.

1. Verify if the facility holds current AASM accreditation by viewing our Sleep Center Directory (if the facility does not hold an AASM accreditation skip step 2 and proceed to step 3).
2. After confirming the facility holds current AASM accreditation complete and submit the Accreditation Complaint Form (verify you are using the current version on the AASM website). The AASM has the authority to perform investigations related to the Standards for Accreditation (confirm this is the current version on the AASM website).
3. File a HIPAA complaint with the US Department of Health and Human Services. Use the HHS online complaint portal to report potential HIPAA violations. The HHS Office for Civil Rights (OCR) is responsible for investigating and determining compliance with HIPAA regulations.
4.  Start the formal complaint process with the facility’s compliance officer

Who determines HIPAA compliance?

HIPAA compliance determinations are made by the appropriate parties — state health departments, medical boards, and HHS. These organizations are responsible for determining compliance with their respective regulations. Once those determinations are made, the AASM can assess compliance with its accreditation standards.
